1. Agreement to Terms

By accessing or using ProductRecallRadar ("Service"), operated by a sole proprietorship registered at KvK 99250926 and BTW NL005377643B18 ("we", "us", "our"), you agree to be bound by these Terms of Service.

2. Description of Service

ProductRecallRadar provides automated monitoring and aggregation of publicly available product recall information from official government databases worldwide. The Service sends alerts based on user-defined filters.

ProductRecallRadar is an informational tool only. It does NOT replace your own compliance monitoring processes. We aggregate publicly available data but make no guarantees about completeness, accuracy, or timeliness. You remain solely responsible for your regulatory compliance obligations.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

5. No Warranty

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT: (a) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; (b) ALL RECALLS WILL BE CAPTURED; (c) ALERTS WILL BE DELIVERED TIMELY; (d) THE DATA IS COMPLETE OR ACCURATE.

6. User Responsibilities

You agree to: (a) maintain your own compliance monitoring processes; (b) verify recall information through official sources; (c) not rely solely on our Service for regulatory compliance; (d) keep your account credentials secure.

7. Subscription and Payment

Paid subscriptions are billed monthly or annually. You may cancel at any time; cancellation takes effect at the end of your billing period. No refunds for partial periods.

8. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately.

9. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of Amsterdam.
